Varta Microbattery GmbH Charged with Patent Infringement

Energy Conversion Devices, Inc. (ECD Ovonics) (Nasdaq: ENER) today announced that its subsidiary, Ovonic Battery Company, Inc., filed a complaint yesterday with the U.S. International Trade Commission (ITC) charging Varta Microbattery GmbH, Varta AG and Varta Microbattery, Inc. (Varta) with patent infringement of Varta's consumer nickel metal hydride battery button cell products. The complaint alleges that Varta has engaged in unfair trade practices by manufacturing and importing infringing batteries into the U.S. and requests that the ITC exclude those infringing products from further importation into the United States.

The complaint was filed under Section 337 of the Trade Act of 1930 which prohibits unfair methods of competition in import trade and is traditionally used to enforce patents and trademarks against international encroachments.
